Information on how to enter form part of these Terms and Conditions. Entry into this Contest is deemed to be an acceptance of these Terms and Conditions.

This Contest commences on [1 October 2023] from 00:00 AM (EST) and concludes on [1 October 2024] (‘Contest Period’).

This Contest is open to residents of Canada (excluding residents of Quebec), who have reached 18 years of age as of the beginning of the Contest Period, and who are not an employee of or domiciled with an employee of; or an immediate family member of an employee of; the Promoter or its affiliated companies, their advertising and promotional agencies.

To enter this Contest, entrants must during the Contest Period:
a) Make any purchase from
evernew.ca (
Ever New Website).
b) Complete and submit the Ever New Post Purchase Survey accessible via the Ever New Website, or which has been sent to their email address registered with the Promoter, and provide their contact details.

Only one entry is permitted per person per qualifying transaction. In store and concession purchases are excluded from this Contest. Entrants who provide incorrect or fraudulent information are ineligible to participate in the Contest. Any attempt to enter multiple email addresses, or any use of robotic, automatic, programmed or any other entry method not authorized by these Terms and Conditions is not permitted. No responsibility is accepted for any entries that are late, lost, misdirected, or not received by the Promoter within the Contest Period.

There will be a total of 12 prize draws to take place on the first day of each month during the Contest Period at 10.00am (EST) during the Contest Period (each, a Prize Draw). If the date of a Prize Draw falls on a public holiday, the Prize Draw will take place on the following business day.

Each Prize Draw will take place at Pacific Centre South, Suite D047701, West Georgia, Vancouver, V7Y 1G5.

There will be one (1) winner for each Prize Draw. The first valid entry drawn at random by the Promoter from all entries received during the preceding Qualifying Period as outlined in the table below, for each Prize Draw will receive a CAD$200 Ever New gift card.

The Promoter’s decision regarding any aspect of this Contest is final and no correspondence will be entered into. The Promoter reserves the right to verify the validity of all entries and disqualify any entrant who fails to comply with or submits an entry which is not in accordance with the Terms and Conditions.

Each Prize Draw winner will be notified via email within 2 working days of the date of each Prize Draw using contact details provided to the Promoter and their name will be published on the Ever New Website. Each Prize Draw winner will be sent a Declaration of Eligibility and Release, which includes a mathematical skill-testing question (“Winner Notification”). Each Prize Draw winner must claim their prize by responding via email, return a signed Declaration of Eligibility and Release and correctly answer the mathematical skill-testing question within 15 days of notification by the Promoter. The Prize will be distributed to each Prize Draw winner within 1 month after each Prize Draw date.

The Prize must be accepted as awarded and is not transferable or redeemable for cash. Lost, stolen or damaged Prizes will not be replaced or refunded. The maximum total prize pool is CAD$2,400 (CAD$200 per month) which is correct at the time of publication. The Promoter accepts no responsibility for any variation in the Prize value. If any element of the Prize is not available due to unforeseen circumstances, the Promoter may provide a substitute prize of equal or greater value. Ever New gift cards are issued subject to the terms and conditions specified on the reverse side of each gift card. Any ancillary costs associated with redeeming a Prize is the sole responsibility of the winner.

If a Prize remains unclaimed after 3 months of the respective draw date, the right of that winner to receive the Prize is extinguished. A substitute prize draw will be held the first day of each month at Pacific Centre South, Suite D047701, West Georgia, Vancouver, V7Y 1G5, comprised of all unsuccessful entries in the Prize Draw. The replacement winner will be notified via email or phone within 2 working days of the draw.

This Contest may be promoted through third party websites. Entrants must comply with the terms of service for those third-party websites when using them to participate in this Contest. This Contest is in no way sponsored, endorsed or administered by, or associated with, those third-party websites.

The Promoter and its associated agencies and companies associated with this Contest and third-party websites referred to in clause 13 will not be liable for any damage or loss whatsoever suffered or sustained regarding this Contest or prizes awarded in the course of this Contest, except for liability which cannot be excluded by law.

The Promoter and its associated agencies and companies associated with this Contest and third party websites referred to in clause 13 are not liable for any incorrect, incomplete, or inaccurate information received or not received in the course of or in connection with this Contest or any problems or technical failures if the deficiency is occasioned by any cause outside the Promoter’s reasonable control including but not limited to technical malfunctions or failures.

The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached these Terms and Conditions or engaged in any unlawful or improper conduct calculated to jeopardize the fair and proper conduct of the Contest. The Promoter also reserves the right to request appropriate identification or other documentation to confirm an entrant’s eligibility to enter and claim a Prize. If the identity of an entrant has not been verified or validated to the Promoter’s satisfaction, that entry will be deemed invalid.

If for any reason this Contest is incapable of running as planned, including due to inappropriate content, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to suspend, cancel, terminate or modify or recommence the Contest, subject to the approval or directions of any relevant regulatory authority.

At the request of the Promoter, the winner agrees to participate in any promotional activities planned by the Promoter and consent to their name and image being used in the Promoter’s marketing materials.

All entries become the property of the Promoter. The Promoter collects personal information in order to conduct this Contest. Entrants who do not fulfill the requirements of the entry process will not be eligible to participate in the Contest. By entering this Contest entrants agree that: (1) the Promoter may disclose personal information to its contractors and agents for the purpose of assisting in the conduct of this Contest; and (2) the Promoter may retain and use personal information for future marketing purposes in relations to its products, services, and offers and for publicity purposes. By subscribing to receive the Promoter’s marketing communications and entering this Contest entrants consent to the Promoter collecting their personal information in accordance with the Promoter’s privacy policy, a copy of which is available at evernew.ca/policy.

These Terms and Conditions shall be governed by the laws of Canada (excluding the laws of Quebec).
